Cold Call

A cold call is an unsolicited call to a person who has not asked to be contacted and has no relationship with the caller. Telemarketing laws limit cold calls, and many are banned for numbers on the Do Not Call list.

Why it matters

Cold calls are the hardest and riskiest form of phone sales. Rules under the Telemarketing Sales Rule and the TCPA restrict who may be called, when, and how. Many agencies avoid cold calling and focus on callers who requested information. Consumers can reduce unwanted calls by registering on the National Do Not Call Registry. Agents who cold call must keep records and honor opt-out requests. Penalties for violations can be significant, so compliance training is important.
