Prior Express Written Consent

Prior express written consent is a signed agreement, on paper or electronic, in which a person allows a seller to send certain marketing calls or texts. It must be clear and name what the person agrees to.

Why it matters

Federal rules require this kind of consent for many autodialed or prerecorded marketing calls and texts to mobile phones. The form must give a clear disclosure and cannot make the consent a condition of buying. Agencies keep records of when, where, and how consent was given. Consent can be withdrawn. Families should read the fine print before submitting an online form, since it may allow calls from several companies.
